By accessing or using the Website in any way – including browsing, submitting a contact form, or scheduling a call. You agree to be bound by these Terms in full. If you do not agree to these Terms, please do not use the Website.
These Terms constitute a legally binding agreement between you and GoNomad Stays. We fully reserve the right to update or modify these Terms at any time without prior notice. The most current version of the Terms will always be available on this page. Your continued use of the Website after any changes are made constitutes your acceptance of the updated Terms.
About – Website & Services
The Website is an informational and marketing platform for GoNomad Stays Inc., a short-term rental property management company based in Calgary, Alberta, Canada. The Website provides information about our property management services, our managed property listings, our service packages, and our team.
The Website allows prospective property owners to learn about our management services and contact us to discuss engagement. It also allows prospective guests to view properties managed by GoNomad Stays and access booking links that redirect to third-party short-term rental platforms including but not limited to Airbnb, VRBO, Booking.com, Expedia, Google Vacation Rentals, Whimstay, and Lodgify (“Third-Party Booking Platforms”).
Important: GoNomad Stays does not process bookings or payments directly through this Website. All property bookings are completed through Third-Party Booking Platforms, and all payment transactions are governed by the terms and policies of those platforms. GoNomad Stays is not a party to any booking contract between a guest and a property owner and accepts no liability for transactions completed on Third-Party Booking Platforms.
Eligibility
By using this Website, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into binding agreements under applicable law. If you are using the Website on behalf of a corporation, partnership, or other legal entity, you represent that you have the authority to bind that entity to these Terms.
The Website is intended for use by individuals and businesses located in Canada, the United States, and other jurisdictions where our services may be offered. We make no representation that the Website or its content is appropriate or available for use in locations outside Canada. Third-Party Booking Platforms and External Links
The Website contains links to Third-Party Booking Platforms – including Airbnb, VRBO, Booking.com, Expedia, Google Vacation Rentals, Whimstay, and Lodgify – through which guests may view and book properties managed by GoNomad Stays.
When you click on a booking link on our Website, you will be redirected to the relevant Third-Party Booking Platform. GoNomad Stays has no control over the content, policies, terms, or practices of any Third-Party Booking Platform and accepts no responsibility or liability for them. Each Third-Party Booking Platform is governed by its own terms of service, privacy policy, and cancellation and refund policies, which you should review carefully before making any booking.
All booking arrangements, payment transactions, cancellation rights, and dispute resolution processes are governed exclusively by the terms of the Third-Party Booking Platform through which the booking is made. GoNomad Stays is not responsible for any disputes, losses, or claims arising from bookings made through Third-Party Booking Platforms.
The Website may also contain links to other external websites for informational purposes. These links do not constitute an endorsement by GoNomad Stays of the linked website or its content. We accept no responsibility for the accuracy, legality, or appropriateness of content on any external website.
Intellectual Property
All content on the Website; including but not limited to text, graphics, photographs, logos, icons, audio clips, video clips, software, and the overall design and layout of the Website which is owned by or licensed to GoNomad Stays and is protected by applicable Canadian and international intellectual property laws, including the Copyright Act and applicable trademark laws.

Limitation of Liability

In any event, the maximum aggregate liability of GoNomad Stays to you for any claim arising out of or relating to these Terms or the Website shall not exceed the total amount, if any, paid by you to GoNomad Stays in the twelve months preceding the event giving rise to the claim. If you have not paid GoNomad Stays any amounts in that period, our total aggregate liability to you shall not exceed One hundred Canadian dollars (CAD $100.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, and in such jurisdictions our liability shall be limited to the maximum extent permitted by applicable law. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable Canadian law.
Indemnification
You agree to indemnify, defend, and hold harmless GoNomad Stays Inc. and its directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses; including reasonable legal fees – arising from or relating to your use of the Website in violation of these Terms, your violation of any applicable law or regulation, your infringement of any intellectual property right or other right of any third party, or any content you submit through the Website.

Scheduling a Consultation Call
The Website provides a link to a third-party calendar scheduling tool through which you may schedule a consultation call with GoNomad Stays. By using this scheduling tool, you agree to be bound by the terms and privacy policy of the relevant third-party calendar service, in addition to these Terms.
Scheduling a consultation call through the Website does not create any contractual relationship or obligation between you and GoNomad Stays. The consultation call is provided free of charge and for informational purposes only. GoNomad Stays reserves the right to decline or cancel any scheduled call at its discretion.
Electronic Messages and Anti-Spam
GoNomad Stays complies with Canada’s Anti-Spam Legislation (CASL). We will only send commercial electronic messages to you if we have obtained your express or implied consent to do so as required by CASL. If you have provided your email address through the Website’s contact form, we may send you messages in response to your specific enquiry, which are considered transactional messages and do not require separate consent under CASL.

Governing Law and Dispute Resolution

Before commencing any legal proceeding, you agree to attempt to resolve any dispute with GoNomad Stays informally by contacting us at info@gonomadstays.com with a written description of your complaint. We will make reasonable efforts to resolve the dispute within 30 days of receiving your notice. If the dispute cannot be resolved informally within 30 days, either party may pursue the matter through the courts as described above.
If you are a consumer resident in a jurisdiction that grants you the right to bring disputes in your local courts or under local consumer protection laws, nothing in these Terms limits that right.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver of any term shall be effective unless made in writing and signed by GoNomad Stays.
